The short version: ShiftWorth is an educational pay calculation tool. It provides estimates, not guarantees. Always consult with HR, your union, or a qualified professional before taking action based on calculations.
1. Acceptance of Terms
By downloading, installing, accessing, or using ShiftWorth ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and the developer of ShiftWorth ("Developer," "we," "us," or "our").
2. Description of Service
ShiftWorth is a mobile application designed to help registered nurses and other shift-based healthcare workers:
- Calculate estimated per-shift earnings including base pay, night differentials, weekend differentials, holiday pay, and overtime
- Estimate overtime and review a blended regular-rate calculation for standard 40-hour workweeks
- Compare estimated earnings between different shifts
- Verify paychecks by comparing estimated calculations against actual pay received
- Estimate federal and state tax withholdings
- Track shift history and generate exportable records
3. Important Disclaimers
3.1 Not Professional Advice
ShiftWorth is an informational and educational tool only. The App is not a substitute for, and does not constitute:
- Professional financial advice or financial planning
- Legal advice regarding employment law, FLSA compliance, or labor disputes
- Tax advice or tax preparation services
- Certified payroll auditing or accounting services
- Official wage-and-hour calculations for legal proceedings
3.2 Calculation Accuracy
While ShiftWorth strives for accuracy in its calculations, all results are estimates and may differ from your actual pay due to factors including but not limited to:
- Employer-specific pay policies, collective bargaining agreements, and institutional rules that vary from standard FLSA calculations
- State-specific overtime laws that may differ from federal FLSA regulations
- Pre-tax deductions (health insurance, retirement contributions, FSA/HSA, union dues) not accounted for in the App
- Employer-specific differential rates that may differ from the rates you enter
- Rounding differences between payroll systems
- Changes in tax brackets, tax law, or state regulations after the App's last update
- Special pay arrangements, stipends, bonuses, or non-standard compensation
3.3 Tax Estimates
Tax withholding estimates are based on published 2026 IRS federal tax brackets and available state income tax rates as of the App's last update. These estimates:
- Do not account for all possible deductions, credits, filing statuses, or exemptions
- May not reflect the most recent changes to tax law
- Should not be used for tax filing or formal tax planning
- May differ significantly from your actual tax withholding or tax liability
3.4 FLSA Calculations
ShiftWorth calculates overtime using the FLSA "regular rate" method as described in 29 CFR §778.115. However:
- Your employer may have legitimate reasons for calculating overtime differently (e.g., Belo contracts, fluctuating workweek agreements, state-specific methods)
- Some differential payments may be excludable from the regular rate under specific FLSA exemptions
- The App cannot account for all possible exceptions, exemptions, or employer-specific circumstances
4. Use at Your Own Risk
You acknowledge and agree that:
- Any actions you take based on ShiftWorth's calculations are at your sole risk and responsibility
- You should verify all calculations with your employer's HR or payroll department, your union representative, or a qualified employment attorney before taking any formal action
- ShiftWorth's calculations should be used as a starting point for discussion, not as conclusive evidence of underpayment
- The Developer is not responsible for any consequences arising from actions taken based on the App's calculations
5. Eligibility
You must be at least 17 years of age to use ShiftWorth. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
6. In-App Purchases
6.1 Pro Upgrade
ShiftWorth offers a one-time in-app purchase ("Pro") that unlocks additional features. The app also includes a 7-day in-app trial for Pro features. After that trial, Free features remain available and you may choose whether to buy the one-time Pro unlock.
6.2 Payment Processing
All purchases are processed through Apple's App Store. By making a purchase, you also agree to Apple's Terms and Conditions.
6.3 Refunds
Refund requests must be directed to Apple through the App Store, as we do not process payments directly. Apple's refund policy governs all purchase-related refunds.
6.4 Restoring Purchases
You can restore your Pro purchase on any device signed in with the same Apple ID by using the "Restore Purchases" option in the App's Settings.
7. Intellectual Property
All content, design, code, graphics, user interface elements, and the overall look and feel of ShiftWorth are the intellectual property of the Developer and are protected by applicable copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, adapt, or create derivative works based on the App
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use the ShiftWorth name, logo, or branding without prior written consent
- Redistribute, sublicense, sell, or commercially exploit the App or its content
8. Acceptable Use
You agree to use ShiftWorth only for its intended purpose as a personal pay estimation tool. You may not use the App:
- For any unlawful purpose or in violation of any applicable laws
- To create a competing product or service
- To generate misleading or fraudulent wage claims
- In any way that could damage, disable, or impair the App's functionality
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
- THE DEVELOPER DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CALCULATIONS, ESTIMATES, OR INFORMATION PROVIDED BY THE APP.
- IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF WAGES, LOSS OF EMPLOYMENT, LOSS OF DATA, OR FINANCIAL LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
- THE DEVELOPER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY).
10. Indemnification
You agree to indemnify, defend, and hold harmless the Developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or any actions you take based on the App's calculations.
11. Termination
You may terminate your use of ShiftWorth at any time by deleting the App from your device. We reserve the right to discontinue the App or any features at any time without prior notice, though given the App's offline nature, previously downloaded versions will continue to function.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in California.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of ShiftWorth and supersede all prior agreements and understandings.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of ShiftWorth after any changes constitutes your acceptance of the modified Terms.
